Annual leave builds up from your ordinary hours, including while you're on paid leave. Unpaid leave doesn't count.

How much annual leave do you get?

Under the National Employment Standards, full-time and part-time employees get 4 weeks of paid annual leave a year, based on their ordinary hours. Shiftworkers who work 24/7 rosters, including Sundays and public holidays, get 5 weeks. Casual employees don't get paid annual leave; they're paid a casual loading instead.

Leave builds up gradually from your first day. A full-time employee on 38 hours a week earns 2.923 hours of leave a week, or 152 hours a year. A part-time employee on 22.8 hours earns 91.2 hours a year, which is still four of their weeks.

Leave loading

Leave loading is an extra payment on top of your normal pay while on leave, usually 17.5%. It isn't part of the National Employment Standards. It comes from your award, enterprise agreement or contract, so check yours. Some shiftworkers get the higher of 17.5% or their shift penalties.

When you leave a job

Any unused annual leave must be paid out when your employment ends, at the rate you'd have been paid if you took it. Leave loading is also paid out if your award or agreement says so. Unused leave paid on a genuine redundancy is taxed at no more than 32%. See the redundancy calculator.

Four times your ordinary weekly hours. On 38 hours a week, that's 152 hours. On 30 hours, it's 120 hours.

Can my employer make me take annual leave?

Only if it's reasonable, for example during a shutdown or when you've built up an excessive balance under your award. Otherwise leave is agreed between you and your employer.

Do I accrue leave while on annual leave?

Yes. You keep accruing annual leave during paid leave, including annual leave, personal leave and long service leave. You don't accrue it during unpaid leave, except community service leave.
