Long service leave in each state
Long service leave rewards employees who stay with one employer for a long time. It's set by state and territory laws, not the Fair Work Act, so your entitlement depends on where you work. Some awards and agreements give more. Here are the general rules for private sector employees:
| State | Entitlement | Paid out on leaving |
|---|---|---|
| NSW | 8.67 weeks after 10 years | From 5 years if dismissed (not for misconduct), ill or for pressing necessity; any reason after 10 |
| VIC | 6.07 weeks after 7 years (1/60th of time worked) | Any reason after 7 years |
| QLD | 8.67 weeks after 10 years | From 7 years for certain reasons; any reason after 10 |
| WA | 8.67 weeks after 10 years | Pro rata on any exit after 7 years |
| SA | 13 weeks after 10 years | Pro rata after 7 years, except serious misconduct |
| TAS | 8.67 weeks after 10 years | From 7 years for certain reasons |
| ACT | 6.07 weeks after 7 years | From 5 years for certain reasons; any reason after 7 |
| NT | 13 weeks after 10 years | From 7 years for certain reasons |
These are simplified summaries. Qualifying reasons, how part-time and casual service counts, and breaks in service vary between states. Check with your state's long service leave authority, especially for Tasmania and the NT. Workers in construction, cleaning, community services and some other industries may be covered by a portable long service leave scheme instead.
How long service leave is paid
You're paid at your ordinary rate of pay when you take the leave. If your hours have changed over time, some states use an average over the last one to five years. When long service leave is paid out on a genuine redundancy, the part that built up after 15 August 1993 is taxed at no more than 32%.
